Couldn't reply to Becky's topic coz the thread has been closed so I'm opening a new one.

While I understand the intellectual rights argument, I would have thought that the more exposure your photos get, the better it is for you. What's more, a stilt seller is showing them to the perfect targeted audience. That has to beat being on MySpace or something similar.

Why not just make a clause obliging people who use any photos found on this site to provide a link back to PoweriserPages.com, perhaps with a tagline like "All photos graciously provided by the members of PoweriserPages.com"?

Identifying each individual poster and mailing him/her for permission is rather a daunting task when you consider that most people look at the gallery and simply right click on any photos they like.

Oh, and guys, please don't scream at me if you don't like my suggestion. It's just a point for debate. I am not saying I'm right, I'm merely trying to look at the problem logically in order to find an acceptable solution for all parties concerned.

The thing is that many people wouldn't mind and would even be pleased if a business/company wanted to use their photos, the problems comes in when they think they can just take them without asking permission.

If they asked permission i'm sure most people would be more than happy with seeing their photo

Like I said Athoul, locating and contacting each individual is very difficult. A blanket "across the board" permission would facilitate the task.

I will start the ball rolling by asking publicly if I may have permission to:
a) use photos/vids from here in my ads, and
b) use photos from here in my posters at the club.

Like I said Athoul, locating and contacting each individual is very difficult.

I totally disagree, when they steal the photos they just go through the PP gallery until they find one they like.
For example say they want this one which Becky took:

My point is that, and this is my case also, people tend to flick through the gallery using the next slide link right clicking and saving every photo they like. I have stored tons from all over the net but I have no idea where I found them all. Retracing one's footsteps to locate the original poster is very difficult and time consuming.

Don't get me wrong. I'm not advocating photo theft, but I am suggesting a single across the board permission would solve the problem in one fell swoop.

It would be completely ignored. To be honest this all exploded after FLYING LOCUST decided to take various photos, some which had already been watermarked and had logos on, cut out the logo and watermarks and stuck their own upwingz logo all over the photo. This is totally unacceptable, especially coming from the main manufacturer of jumping stilts.

Also Becky sells some of her photos so simply taking them is essentially taking money from her.

Unfortunately the internet is not a nice place. Good job you cant just right click on peoples cars and houses and take them :/ The given rule is that if its online, someone will take it, which is why most decent pics are now heavily watermarked rather than a little logo in the corner.
I agree, the marketing angle is good but it was the mannor and ignorance that it was done with that caused this.

I guess ultimately, its up to the original owner.

That would require everyone to agree to that on pp.com. If a retailer wants to use a picture they should go to the trouble of asking permission. Its not complicated, even if it is time consuming. I personally want to be asked for permission before a retailer uses my shots. Unfortunately that hasn't happened and I am one of the people affected.

Here's why that wouldn't work, PP's goal (as i see it) as far as the gallery is to allow all bockers to share what they're doing all over the world with the rest of the community.  Not to provide stilt resellers with free promotional materials.  If people want to allow their photos to be used by sellers that is up to them, but not all of us do.  Also if we gave blanket permission requiring a link back to the original I doubt anyone would follow it, they'd read as far as "you can use it" and then start copying.

People post their photos on this website and others like it to show the rest of the powerbocking community how they are progressing, what they have done and how much fun they are having.

Some companies are taking the photos without asking and watermarking them as their own, see Kiola's picture below, from http://upwing.en.alibaba.com



These companies are then selling their product based on the photos that people see on their site, so are making money from your photo, but it is your photo, so they are making money from you! Also the stilts featured in the photo arent the product they are selling, again see Kiolas picture, the people in the photo are not on Upwings - so is this not also false advertising?

A lot of people on here would be happy for a photo to be used as long as permission is gained, but others use photography to make their money - so a company taking their photos without paying for them, is like you doing a days work for free!

I have no problem with powerbocking communities using my photos as long as they ask for permission, eg: http://www.powerisers.org.nz who asked permission to use the photo of Elton on their front page. Community sites are spreading the sport and encouraging people to take part. They are not making any profit from a photo that isnt theirs.

There is a link under every photo, and if you like the photo enough to wish to use it you should make the effort to contact the owner and gain their permission first. Or end up being black-listed across the powerbocking world! Smiley

I wasn't talking about a link back to the original. I said a link back to PoweriserPages.com. It's clear that some of you would not agree with that however, you have placed your photos on this site for interested people to view them. Unlike everday well known products, bocking is still very new and relatively unknown so people are hungry to see as much as they can. Under this premise, a link back to this site will allow interested parties to view all your photos and become members of the community if they so wish.

What I disagree with is photo/video fraud such as that demonstrated by Becky above and companies like Bowei Powerwell who take SweBounce videos and watermark them with a Skyrunners logo. Aside from the blatant copyright infringement, there's nothing in their videos that are related to the Skyrunner product. But then I already explained in another thread how the chinese could not care less about cloning and stealing as long as they make money from it.

I suppose the bottom line is do you wish to enforce permission requests from each individual posting photos here which will only serve to increase the photo theft that has been taking place, or do you want to allow blanket permission in exchange for a link back to this site to be given to those sellers honest enough to uphold their end of the bargain? You could still blacklist anyone who fails to keep up their side of the deal.

I have been posting quite a bit here since becoming a member. I think you guys can see I'm keen to be an active community member. I have admitted to having collected a heap of your photos but none have been used in any ads to date. I have asked for blanket permission but nobody has yet granted it. My main goal is to get the sport known and make sure it gets a good reputation. I can't hide that I will sell stilts also. I suppose the remaining question is do you see me as someone who will show you off in the best possible way or just someone looking to exploit your photos for his own personal gain?  Undecided

I don't think you can get blanket permission for this. If one person came and said what photos could be used, that would leave many people upset, especially if they didn't want their photo published. Really not good to have one person speak for 50+ others. 

I suppose that for every photo you find, just take names, and from which ask blanket permission from the individual for use of their photos.
